IT WAS all over in a matter of seconds. Senior Constable David Rixon had allegedly spotted the disqualified driver behind the wheel of a car and pulled him over for a random breath test.
What happened next will probably be determined in court. Michael Alan Jacobs, 48, now faces a murder charge.
Mr Jacobs, from South Tamworth, was flown to John Hunter Hospital in a critical condition immediately after the incident, and has remained there under police guard since the fatal event on March 2.
He had only recovered sufficiently by yesterday morning for homicide detectives carrying out the critical incident investigation to be allowed to speak to him. He declined to participate in a formal interview, and the murder charge was formally laid.
Mr Jacobs did not face Newcastle Local Court yesterday where the case was briefly mentioned, and he was remanded in custody to reappear on May 16.
Homicide Squad Commander Superintendent Michael Willing told reporters police will allege Jacobs acted alone and was not in the company of another man arrested that day. The other man was released without charge.
